General Terms and Conditions for Accommodation Contracts – Mas L’Epicure
These Terms and Conditions govern the contractual relationship between the operator of the accommodation “Mas L’Epicure” and guests (consumers and, where applicable, business clients) regarding the booking of rooms and related services.
This English version is provided for information and transparency only; the contract is governed by French law and, where made available, by the French version of these Terms and Conditions.

2. Scope of application
-
These Terms and Conditions apply to all contracts for temporary accommodation at Mas L’Epicure and any related services (e.g. breakfast, parking, additional services).​

Any terms and conditions of the guest shall only apply if expressly agreed in writing by the operator.​

For bookings made via third‑party platforms (e.g. online travel agencies), the terms of those platforms take precedence; these Terms and Conditions apply in addition where they do not conflict.​
3. Conclusion of contract and booking process

All offers on the website and in other media are non‑binding and subject to availability.​

A binding accommodation contract is formed when the operator confirms the booking (by e‑mail or platform message).​

To secure the booking, the operator may request a deposit or a pre‑authorisation of a credit card:

Deposit: for stays of 1–3 nights, a deposit of 1 night is required; for stays of more than 3 nights, a deposit of 30% of the total amount is required, payable within 7 days of booking confirmation.​

Credit card pre‑authorisation / security deposit: 100 € and 48 hours before arrival.​

If the deposit or pre‑authorisation is not received in due time, the operator may cancel the reservation.​
4. Rates, taxes and charges

Room rates are quoted per room and night, including breakfast for rooms and excluding breakfast for the apartment, and include applicable taxes unless stated otherwise.​

The local tourist tax (“taxe de séjour”) is not included in the room rate and will be charged in addition: 0.70 € per person per night; exemptions for children under 18 apply according to local regulations (municipality 84190 Vacqueyras).​

Additional services (e.g. extra bed, pets where allowed, pool towels, beverages, meals, products for sale) are charged separately according to the price list in force at the time the service is provided.​
5. Payment terms and currency

Accepted means of payment: Visa, Mastercard, EC/debit card, cash, bank transfer.​

Unless otherwise agreed:

The remaining balance is payable at check‑in or check‑out, including any additional services.​

For “non‑refundable” or advance purchase rates, the total amount is due at the time of booking.​

All payments are made in EUR; for card payments in other currencies, the conditions of the card issuer apply.​

Invoices are issued manually and can be sent by e‑mail on request.​
6. Cancellations, changes and no‑show

Bookings can be cancelled free of charge up to 30 days before the scheduled arrival date, 18:00 local time.​

Thereafter, the following cancellation fees apply:

13–7 days before arrival: 50% of the total booking amount

From 7 days before arrival: 90% of the total booking amount.​

In case of no‑show (guest does not arrive without cancellation), 100% of the total booking amount will be charged.​

Early departure or shortening of the stay is treated as a no‑show for the remaining nights and charged accordingly.​

Changes to the reservation (dates, number of persons, room category) are subject to availability and may result in rate adjustments; no separate rebooking fee is charged.​

Notice on right of withdrawal: Accommodation services for a specific date or period are exempt from a 14‑day statutory right of withdrawal under EU and corresponding French consumer law.​
7. Check‑in, check‑out and registration

Check‑in: from 16:00; later arrivals are possible by prior arrangement only.​

Check‑out: by 10:00; late check‑out is subject to availability and may incur an additional charge.​

Guests must present valid identification at check‑in. For foreign nationals, completion of the legally required “fiche individuelle de police” (registration form) is mandatory.​

Minors may only stay if accompanied by a parent or legal guardian.​
8. Room use, occupancy and visitors

Maximum occupancy per unit: double rooms 2 persons, apartment 2 persons, family suite 4 persons. Children count as persons unless expressly stated otherwise.​

Children: from 12 years; extra bed 30 € per night, subject to availability.​

Visitors are only permitted with prior consent of the operator; overnight stays of unregistered persons are not allowed.​

Any commercial use of the rooms, parties or events is prohibited unless expressly approved in advance.​
9. House rules, quiet hours, smoking, pets

The house rules in their current version form part of the contract and are available in the information folder in the rooms.​

Quiet hours: 22:00–07:00.​
-
Smoking and vaping are strictly prohibited in all indoor areas. In case of violation, a special cleaning fee of 50 € will be charged.​
-
Pets are accepted on prior request only. Where accepted, a surcharge of 25 € per day applies and specific rules (e.g. leash requirement, no access to breakfast room and pool area) must be adhered to.​
10. Common areas, pool/garden and parking

The use of common areas (e.g. garden, terrace, lounge) is reserved for in‑house guests during the posted opening hours (approx. 07:00–22:00).​

Pool / wellness area: opening hours approx. 08:00–21:00; all safety and hygiene regulations must be followed. There is no lifeguard on duty; children may only use the pool under adult supervision, and use is at the guest’s own risk.​

Parking is provided free of charge and subject to availability. The operator accepts no liability for damage to vehicles except where caused by its own fault.​
11. Breakfast and additional services

Breakfast for rooms is included in the room rate and is usually served from 09:00 to 10:30. Guests must inform the operator in advance of any allergies or intolerances; additional costs may apply for special requests.​

Breakfast for the apartment is not included in the rate and may be booked separately subject to availability.​

Additional services (e.g. bicycle rental, transfers, tastings) are available on request and subject to charges; separate conditions may apply.​
12. Duty of care, damage and security deposit

Guests are required to treat the rooms, furnishings and all facilities with due care and to report any defects or damage without delay.​

Guests are liable for any damage caused by them or by accompanying persons or visitors. The operator may use the security deposit or credit card pre‑authorisation to cover such damage; if no deposit has been provided, the guest remains fully liable and must settle the damage immediately.​

Fixed compensation amounts: loss of key 80 €; heavy soiling 60 €. The operator reserves the right to claim higher proven damages.​
13. Liability of the operator

The operator is liable without limitation for damages resulting from injury to life, body or health caused by intentional or negligent breach of duty, as well as for damages caused by intentional or grossly negligent conduct.​

In the event of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical contractual damage.​

The operator assumes no liability for valuables brought by the guest unless damage is due to the operator’s fault; use of any available safes is recommended.​

The operator is only liable for disruptions or services provided by third parties (e.g. external transport, external activities) in cases of fault in selection or supervision.​
-
Statutory warranty rights remain unaffected.​
14. Force majeure and exceptional circumstances

Events beyond the reasonable control of the operator (e.g. natural disasters, epidemics, official orders, failure of critical infrastructure) entitle the operator to adapt, postpone or terminate the contract for good cause.​

Payments already made will be refunded in accordance with statutory provisions; any further claims are excluded to the extent permitted by law.​

15. Data protection

Data controller: the operator named in section 1.​

Categories of personal data: identification and contact details, booking and payment details, legally required registration data (for foreign guests), communication content, preferences (e.g. room, allergies where voluntarily provided).​

Purposes / legal bases: performance of the contract and pre‑contractual measures; compliance with legal obligations (e.g. registration and tax law); legitimate interests (security, fraud prevention, direct communication regarding the stay); consent where required (e.g. newsletters).​

Recipients: payment service providers, booking platforms, tax and supervisory authorities within the legal framework, IT and hosting providers; otherwise only where legally justified.​

Storage period: for the duration of the contractual relationship and in accordance with statutory retention periods; registration forms for foreign guests are retained for the legally prescribed period.​

Data subject rights: right of access, rectification, erasure, restriction, objection, data portability and right to lodge a complaint with the competent data protection authority (CNIL).​

16. Complaints and consumer dispute resolution

The operator will endeavour to reach an amicable solution with the guest.​

A competent consumer mediator in accordance with French law will be designated. Use of mediation is voluntary and does not affect statutory rights.​
17. Applicable law, jurisdiction, contract language

These Terms and Conditions are governed by French law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).​

For actions brought by the operator against consumers, the statutory rules on jurisdiction apply. Consumers may bring claims either at their place of residence or at the place of accommodation, as provided by law.​

For guests who are not consumers, the exclusive place of jurisdiction is Carpentras / Avignon, France.​

The contractual language is French. As the operator speaks German, German is used in practice; translations into other languages are provided for information purposes only.​
18. Amendments to these Terms and Conditions

The operator may amend these Terms and Conditions for future bookings at any time. For each booking, the version valid at the time of contract conclusion applies.​
19. Severability

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by the applicable statutory rule.​
20. Priority of individual agreements

Individually agreed terms (including side agreements, amendments and additions) shall take precedence over these Terms and Conditions if confirmed in writing.​
21. Special rates and vouchers

“Non‑refundable” and special promotion rates are subject to separate payment and cancellation conditions which are displayed at the time of booking.​

Vouchers may be redeemed subject to availability, are non‑transferable, cannot be exchanged for cash and are valid for 365 days from the date of issue.​
22. Sustainability and safety

Short information on energy, water and waste management can be obtained from the operator.​

Guests must comply with all posted safety instructions (e.g. emergency exits, pool rules, fire safety notices).​
